Terms of Service

These Terms of Service ("Terms") govern your use of the websites, apps, communications, and services provided by Moddog Corporation ("ModDog," "we," or "us") (the "Service"). By joining our waitlist or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Early access

The Service is an invitation-only early-access product. It may change, contain errors, be unavailable, or lose data, and we may modify, suspend, or discontinue any part of it at any time. Joining the waitlist does not guarantee access.

2. Eligibility and accounts

You must be at least 18 years old and located in the United States to use the Service. You are responsible for providing accurate information, keeping your sign-in methods secure, and all activity under your account.

3. Training guidance and AI

The Service provides dog-training guidance, some of which is generated by artificial intelligence. Guidance may be inaccurate or unsuitable for your dog or situation. Use your own judgment and stop any activity that appears unsafe or causes your dog distress.

The Service does not provide veterinary, medical, or emergency services. Consult a qualified veterinarian or professional for health, safety, or behavioral concerns. You are solely responsible for your dog and for the safety of people and animals around it.

4. Communications

We may send you communications related to your account and the Service, including coaching communications connected to your training. You can opt out of coaching communications at any time using the unsubscribe link or your account settings. We may still send messages required to operate your account.

5. Your content

You retain ownership of the content you submit, such as messages, photos, videos, and information about you and your dog. You grant ModDog a worldwide, royalty-free license to use, host, store, reproduce, modify, and process your content to operate, provide, and improve the Service, including through review by our team and use in developing our models. You represent that you have the rights needed to submit your content. If you give us feedback, we may use it without obligation to you.

6. Acceptable use

You agree not to misuse the Service, including by violating any law or the rights of others, harming people or animals, submitting unlawful or harmful content, accessing accounts or data that are not yours, interfering with or circumventing the Service's security or operation, or accessing the Service by automated means without our permission.

7. Our property

The Service and its content, software, and branding are owned by ModDog or its licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service.

8. Third-party services

The Service may rely on or link to third-party services, which are governed by their own terms. We are not responsible for third-party services.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time for any reason, including if we believe you have violated these Terms. Provisions that by their nature should survive termination will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE, OR THAT IT WILL ACHIEVE ANY PARTICULAR RESULT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MODDOG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnification

You agree to indemnify and hold ModDog harmless from claims, losses, and expenses arising from your content, your use of the Service, your dog, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

14. Changes

We may update these Terms from time to time. If we make material changes, we will provide notice, such as by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance.
